conditions of participation
Participation in the MAX CARBON competition is free of charge and is governed exclusively by these terms and conditions.
procedure of the competition
The competition runs from November 30, 2024 to December 8, 2024. Users will have the opportunity to participate in the competition during this period.
participation
To take part in the competition, you must follow and tag @maxcarbon.de on TikTok or Instagram. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.
Only one submitted entry per participant will take part in the competition. It is strictly prohibited to use multiple entries to increase your chances of winning.
Participation in the competition is free.
eligible participants
Natural persons who are resident in Germany and are at least 14 years old are eligible to participate. Participation is not restricted to customers of the organizer and is not dependent on the purchase of a product or service.
If a participant is limited in his legal capacity, the consent of his legal representative is required.
All persons involved in the conception and implementation of the competition and employees of the operator as well as their family members are not eligible to participate in the competition. In addition, the operator reserves the right, at its own discretion, to exclude persons from participation if there are legitimate reasons, for example (a) in the event of manipulation in connection with access to or implementation of the competition, (b) in the event of violations of these conditions of participation, (c) in the event of unfair conduct or (d) in the event of false or misleading information in connection with participation in the competition.
Prize, notification and delivery of the prize
The following prizes will be awarded: 1x Carbon Luggage
8x Carbon shoulder bag
The winners will be determined after the closing date in a random draw among all participants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the draw.
The winners of the raffle will be informed of their win promptly via a separate email.
The prize will only be handed over to the winner or to the legal representative of the minor winner. The prize cannot be exchanged, collected in person or paid out in cash.
Any costs incurred for sending the prizes will be borne by the operator. Any additional costs associated with claiming the prize will be borne by the winner. The winner is responsible for any taxation of the prize.
If the winner does not respond after being asked twice within a period of 3 weeks, the prize can be transferred to another participant.
termination of the competition
The organizer expressly reserves the right to terminate the competition without prior notice and without stating reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.
data protection
To participate in the competition, you must provide personal information. The participant assures that the personal information he or she provides, in particular first name, last name and email address, is true and correct.
The organizer points out that all personal data of the participant will not be passed on to third parties or made available to them for use without consent.
An exception are companies commissioned to carry out the competition, which must collect, store and use the data for the purpose of carrying out the competition.
In the event of a win, the winner agrees to the possible publication of his or her name and place of residence in the advertising media used by the organizer. This includes the announcement of the winner on the operator's website and its social media platforms.
The participant can revoke his or her consent at any time. The revocation must be sent in writing to the contact details of the organizer provided in the imprint section. After revocation of the consent, the participant's collected and stored personal data will be deleted immediately.

The operator's competition is subject exclusively to the laws of the Federal Republic of Germany. Legal recourse is excluded.
severability clause
Should a provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. Instead of the invalid provision, the legally permissible provision shall apply which economically comes closest to the meaning and purpose expressed in the invalid provision. The same applies if there is a regulatory gap in these terms and conditions of participation.

Conditions of participation for the competition “Break this piece of carbon!” at EMS 2024
1. Organizer
The organizer of the competition is MAX CARBON GmbH , based in Germany, hereinafter referred to as the “organizer”.
2. Eligibility
2.1 Natural persons aged 18 or over residing in Germany who follow the Instagram account @maxcarbon.de and create a post about our challenge on Instagram are eligible to participate.
2.2 Employees of the organizer and their relatives are excluded from participation.
2.3 Participants who cannot provide a valid Instagram connection or who violate the conditions of participation will be excluded from the competition.
3. Participation
3.1 Participation is only possible on-site at the stand in Hall 5, stand number 5C10 at EMS 2024.
3.2. The prerequisite for participation is:
- Following our Instagram account ( @maxcarbon.de ).
- Creating an Instagram post (post or story) that documents participation in the challenge and tags @maxcarbon.de .
- Attempting to break a piece of carbon provided by us with your bare hands.
3.3. Each person may only participate once.
4. Prize and Conditions
4.1 Participants who manage to break the piece of carbon using only their hands will receive a prize of €1,000 (either in cash or by bank transfer).
4.2 Participants who fail to break the piece of carbon will not receive any prize.
4.3 The prize is not transferable.
5. Rules for the fracture test
5.1. The carbon piece may only be broken with bare hands.
5.2 The use of aids, machines or other forms of force (e.g. kicks, objects or leverage) is not permitted.
5.3. Violations of these rules will result in immediate exclusion from the challenge.
6. Duration of the competition
The competition will take place from November 29, 2024 to December 8, 2024 during the opening hours of EMS 2024 at the exhibition stand in Hall 5, stand number 5C10 .
7. Notification and payment of the prize
7.1. The prize will be paid out in cash on site or can alternatively be paid out by bank transfer.
7.2 Participants must prove their identity and provide their contact details before the prize can be paid out.
8. Data Protection
8.1. The personal data collected as part of the competition will be used exclusively for the purpose of conducting the competition.
8.2. By participating, participants agree that we may use their Instagram post and, if applicable, image or video material from the challenge for marketing purposes.

9. Liability
The organizer assumes no liability for injuries or damages resulting from improper execution of the challenge.
10. Exclusion from the competition
10.1 The organizer reserves the right to exclude participants who violate the conditions of participation or the rules of the challenge from the competition.
10.2 Participants who behave in an unsportsmanlike or uncooperative manner may be disqualified.
11. Miscellaneous
11.1 Legal recourse is excluded.
11.2 The law of the Federal Republic of Germany applies.
